FinderFox Terms and Conditions

1. Parties' Responsibilities. You are solely responsible for your sites, SmarterFox is not responsible for anything related to your sites. In addition, SmarterFox shall not be obligated to provide notice to you in the event that any feature of FinderFox is not being displayed or running properly.

2. Prohibited Uses. You shall not use FinderFox to damage, disable, overburden, or impair SmarterFox's or any other party's services or servers.

3. Termination; Cancellation. You may stop using FinderFox at any time by removing the FinderFox JavaScript code from your site. You must also remove such programming from your site upon our request. SmarterFox may at any time, in its sole discretion, also terminate or suspend all or part of this Agreement for any reason, at any time. 

4. No Warranty. SmarterFox MAKES NO WARRANTY, EXPRESSED OR IMPLIED, AND EXPRESSLY DISCLAIMS THE WARRANTIES OR CONDITIONS OF NONINFRINGEMENT, MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR ACCURACY OF INFORMATIONAL CONTENT. SmarterFox MAKES NO WARRANTY THAT THE SITE WILL MEET YOUR REQUIREMENTS, OR THAT SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE, NOR DOES SmarterFox MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF FinderFox OR THAT ALL DEFECTS WILL BE CORRECTED.

5. LIMITATIONS OF LIABILITY. IN NO EVENT WHATSOEVER SHALL SmarterFox BE LIABLE FOR ANY DAMAGES. YOU UNDERSTAND AND AGREE THAT THE USE OF THIS SITE IS AT YOUR DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM ITS USE.

6. Indemnification. You agree to indemnify and hold SmarterFox and its affiliates harmless, including reasonable attorneys' fees, from any claim or demand made by any third party in connection with or arising out of your use of FinderFox.

7. Use of Information. When you use FinderFox, FinderFox may collect, store, and periodically send information back to SmarterFox or third party servers.

8. Right to Modification. We reserve the right to modify some or all parts of this Terms and Conditions Agreement at any time without prior notice. A current copy of this Agreement will always be available on smarterfox.com.
